Let me stress the same before answering the Sahih Bukhari chapterization argument.<br /><br />1- If stoning is related to what is mentioned in Qur'an 5:33 why is there no evidence for such a nature of the crime of people stoned to death by the Holy Prophet (saaw)? In fact the cases of Ghamidia and Ma'iz do not have even the remotest suggestion for what Ghamidi and you speak for.<br /><br />2- Verse 34 says that if anyone of those mentioned in verse 33 is repents before being overpowered then they be forgiven but the two examples discussed show the two individuals came after repenting i.e. they repented before presenting themselves to the Prophet (saaw) and yet they were stoned to death. <br /><br />Coming to the Chapterization of Sahih Bukhari, firstly as it seems the chapterization like that is not right and not even universal and agreed upon.<br /><br />1- Ibn Hajr al-Asqalani discusses the point of title "KITAB al-Muharibeen" in Fath al-Bari and concludes;<br /><br /> فالأولى أن يبدل لفظ كتاب بباب وتكون الأبواب كلها داخلة في كتاب الحدود <br /><br />"And it is better to change the word "Kitab" (i.e. Book) with "Baab" (i.e. Chapter) and that all these chapters (including Baab al-Muharibeen) are made part of the "Kitab al-Hudud"<br />http://www.islamweb.net/newlibrary/display_book.php?idfrom=12464&idto=12465&bk_no=52&ID=3753<br /><br />2- With Ibn Battal (d. 449 A.H.) the chapters of rajm are a separate book "Kitab al-Rajm" and not included in Kitab al-Muharibeen.
